Trial attorney Nicholas A. Pascale, Esq. obtained a defense verdict in favor of the Newburgh Enlarged City School District on May 19, 2011. The verdict of no negligence came on a unanimous six-zero vote after a three day jury trial. The plaintiff claimed to have sustained an inversion type injury to his right ankle in the nature of an osteochondral defect necessitating surgical intervention. The plaintiff complained, among other things, that his injury was the result of negligent supervision of his high school physical education class and the alleged negligent utilization of a foam divider to bifurcate the gymnasium for multiple activities. The district strongly defended the claim and steadfastly maintained that it was not negligent throughout the lawsuit. The jury agreed, returning a verdict of no cause after its deliberation.
